-REMEMBER: Depending when you place your cancellation, you can have a month or two of services left in which you can enjoy our facility! Also, it is your responsibility to ensure payment is cleared for all final membership fees.Should payment be stopped or an account is closed a lawsuit will be filed immediately!

Terms and Conditions: I wish to CANCEL my draft membership at Total Body Gym & Tan. I acknowledge and agree that when I signed up it would take 35 bank days to cancel this membership, not counting weekends or holidays (which can also take longer should my original draft agreement state). I will make sure the monies are in the bank for the final draft(s). I am also aware that I could be entitled to a month or more in a membership depending on when my draft cancellation takes effect. I acknowledge that a ADDITIONAL fees could be added on to the draft SHOULD MY DRAFT RETURN from my bank with a NSF ($50) plus $5 for each additional run, until payment clears, Stop Payment ($50), or Closed account($55). I also acknowledge that the access card is property of Total Body Gym and Tan, and is due  in accordance to these terms and agreement, as well as my confirmation letter once I receive it. Should I keep the access card, my bank account could be assessed a $5 daily late charge until the card is returned plus additional monthly cash price membership and non return card fees of $35 and if my card is damaged a $25 fee. If I do not return the access card, it is an implied consent that I wish to continue my membership at a monthly cash price and will be charged a monthly cash price until the card is received with my notice of cancellation. I will receive notice of when my last draft will occur, and when access card is due. I acknowledge that I can drop the card in the INSIDE drop box, or the mail box outside but until it is in the confirmed possession of Total Body Gym & Tan I am held completely responsible for all responsibilities it holds. I acknowledge that it is MY responsibility to ensure that the card is working when received and that my account is satisfactory or I could be charged with additional fees. I acknowledge I can and will be held legally responsible for any and all legal fess, court cost, and past due balance, should my account be placed in collections for a past due balance.  

Acknowledgment and Agreement: By EMAILING THIS DOCUMENT or PRINTING AND MAILING THIS DOCUMENT WITH MY SIGNATURE, I have completed an electronic signature in accordance & agreement with the cancellation process. NO other type of notifications will be accepted.* I can be held legally bondable to my cancellation request, terms and agreement. I understand that should I submit this request and NOT turn in my access card, I can be held liable for additional monthly membership prices because it is interpreted as implied consent that I wish to continue my membership as a cash paying customer. I also understand that should my final draft come back NSF, Stop Payment or Closed account, a lawsuit WILL BE FILED and I will then be responsible for all membership fees incurred and court cost and filing fees.  

Legal Notification: Total Body Gym & Tan will lawfully collect all fines and fees allowed by law and through terms of service. Collection negotiation are only conducted during the time of past due status and prior to lawsuit. During this time is the only time that an allowance of a reduction is allowed. Any time after the litigation process begins or lawsuit has been filed you will be held responsible for all fees and fines applicable to your account. You should know after a stop payment or closed account is received we are lawfully allowed to file suit immediately upon receiving the notification. You will be responsible for all court costs in addition to all other fees produced by Total Body Gym & Tan once a lawsuit has been filed.  


*NOTICE*you can NOT just turn in your access card, you can NOT just email basic information. you must agree to the terms and conditions in order to cancel and send your request properly AS REQUESTED ABOVE and receive notification of confirmation in order for it to be valid. Only a valid cancellation form and returned access card grant you amnesty from fees or fines from accruing after your last draft.

NOTE: There are 2 ways to cancel. ONE: Inside drop box/Outside mailbox or TWO: online here.
-If your card is no longer working due to nonpayment, then please be sure to drop the card off inside with the clerk during business hours. if not you can incur additional fees.
-You can also drop the card in an envelope in our mail box up front - but you are responsible for any actions that may occur to the card until it is in confirmed possession of Total Body Gym.
-If you do not turn in the card, you will incur additional charges for the card.
-If your card is damaged, cracked, or not working due to your negligence, you will incur additional charges.
